Government Initiative

  • Till now foreign direct investment (FDI) up to 100 per cent was allowed for cash and carry wholesale trading and export trading under the automatic route and FDI up to 51 per cent was allowed in single-brand products. However, the Government recently passed a cabinet note and permitted FDI up to 51 per cent in multi-brand retailing with prior Government approval and 100 per cent in single brand retailing, thus further liberalising the sector.     The much-awaited FDI policy for multi-brand retail has passed the hands of the Government. According to Government of India\’s notification on 20 September 2012, 51 per cent FDI in multi-brand retail is permitted, subject to certain conditions. Some of the top conditions cited are as follows:

  • State acceptance: The stores may be set up in those states which allow FDI in multi-brand retail under this policy. Such stores will be subject to compliance with applicable state laws and regulations.
  • Minimum investment: The minimum amount that a foreign investor has to invest is USD 100 million.
  • Backend investment: At least 50 percent of the total FDI brought in shall be invested in \’backend infrastructure\’ within three years of the first tranche of FDI.
  • Procurement: At least 30 percent of the procurement of manufactured/processed products purchased shall be sourced from \’small industries\’ globally, with investment in plant and machinery not exceeding USD 1 million.
  • Location: Retail sales outlet may be set up in cities with populations of more than 1 million, according to the 2011 Census and may also cover an area of 10 kilometers around the municipal/urban agglomeration limits of such cities. Only 53 cities in India qualify under this criterion.
  • Agricultural produce: First right of procurement lies with the Government.
  • These conditions clearly indicate an opportunity for global retailers to harness the vast potential of Indian markets. The development is likely to generate increased

    USPTO partially confirms validity of Amazon “1-click patent”

    Today, the United States Patent and Trademark Office (USPTO) issued an office action, which confirmed the patentability of claims 6 to 10 of the Amazon 1-Click patent, US 5,960,411. The patent examiner, however, rejected claims 1 to 5 and 11 to 15. Amazon now has up to six months to amend the rejected claims to overcome the examiner’s rejection, provide arguments to demonstrate that the examiner is in error and/or provide evidence to demonstrate the patentability of their claims. During this period, the entire patent is still considered valid under US patent law.

    The USPTO is reconsidering the patentability of the claims due to a request for reexamination filed by New Zealander Peter Calveley. Mr. Calveley used internet archives to show that defunct company Digi Cash used a similar technique prior to Amazon. Despite costing a substantial sum of cash and requiring donations to prepare and file the request for reexamination, Calveley said he did it as a game and hopes that his success inspires others to play the same game.

    “One Click” shopping is an ecommerce technique, which allows a customer to purchase products via the Internet without repeatedly entering personal information such as name and address. At the time it was introduced it eased the frustration of on-line shopping.

    Amazon filed the patent application for 1-click shopping in early 1997 and was granted the patent in September 1999. 23 days later Amazon sued rival Barnes & Noble for alleged infringement by its “Express Lane” ordering which was introduced in 1998. In December 1999 Amazon won an interim injunction against Barnes & Noble but the USA Court of Appeals for the Federal Circuit lifted this injunction in February 2001. The parties then settled their dispute for undisclosed terms. Amazon has since successfully licensed the technique to other e-sellers such as Apple.

    Fannie Mae home loans as well as Freddie Mac were both founded by Congress in an attempt to add money to the housing market. Both of these companies give lenders the opportunity to get money for their mortgage investments via securities. Also, these companies are both government sponsored enterprises (GSEs).

    Fannie Mae and Freddie Mac purchase mortgages from lenders. They then put them into packages and turn around and sell them to investors. What this does is essentially add liquidity to the market. Fannie Mae home loans mostly buy mortgages. Freddie Mac makes guarantees on loans and gets money from their fees. They arent the ones who directly give out the loans, but they are the insurance programs that make the loans more cost effective. They both operate only in the United States.

    You will begin to see a big difference in the two companies if you own multiple properties. As a borrower, Freddie Mac will only allow you to have up to four units. With Fannie Mae home loans you can have up to ten properties.

    A second major difference between the two is that they each require you to have different amounts of money readily available at the time the financing is requested. With Fannie Mae you just need two months worth on hand. However, with Freddie Mac you have to have at least six months worth readily available. For those people who are purchasing investment properties, this can make or break their decision.

    The two companies also differ when it comes to down payments. You can put down just three percent with Fannie Mae home loans. However, this is not the case at all with Freddie Mac. You cannot take out a loan with them for anything that goes above 95% loan to value. This essentially means that you will need to have at least 5% for your down payment. Both companies have special programs which can significantly lower the down payment in the event that the borrower meets the loan criteria.

    The reason why Freddie Mac and Fannie Mae home loans have rules is so that home loans will be more affordable for people. These companies are simply meant to put more money into the housing market, period. They insure the loans that they purchase from the banks before they resell them out on the market.

    Do not get these companies mixed up with the Federal Housing Administration. What they offer is totally different. The FHA actually directly offers the loans to people, while Fannie Mae and Freddie Mac do not. You can still be considered if you have a tarnished credit history, but you should expect to make a big down payment. You will also be charged a higher interest rate if you have a bad credit score.

    After coming to the conclusion that you want to buy a house, it will be absolutely vital that you come to terms with your financing options. Most lenders will be happy to help you if you still do not understand the difference between Freddie Mac and Fannie Mae home loans.

    As I was reading I thought, Holy Crap, how can a judge do this.. then I read other sources like the lady’s own blog.. The judge didn’t just decide to remove her kid as this article suggests. Her Ex husband Jeff filed a custody suit after hearing from the son about some of the crazy stuff the judge didn’t like. The fact that the article doesn’t mention that her son wasn’t living with her and that the courts were responding to complaints by the child’s parent and guardians is disturbing and demonstrates a very onse side POV type of article. The info is presented in a real persuasive way.. Just some thoughts.

    World Health Organization calls for ban on tobacco ads

    The United Nations health agency the World Health Organization (WHO) has called for a ban on tobacco advertising and promotion in order to protect the world’s children. The news release from the WHO came on Friday, one day before the annual World No Tobacco Day held each year on May 31.

    This year’s World No Tobacco Day focuses on highlighting the practices of tobacco companies in their efforts to promote their products to young people. According to a WHO press release, studies show that young people are more likely to start smoking if exposed to tobacco advertising. The WHO notes that only five percent of the world population “is covered by comprehensive bans on tobacco advertising, promotion and sponsorship”.

    “The WHO appeals to member states and policy-makers to require by law a comprehensive ban on all forms of advertising, promotion, and sponsorship of tobacco products,” said WHO Regional Director for Africa Luis Sambo, in a statement released Saturday in Kampala, Uganda.

    “In order to survive, the tobacco industry needs to replace those who quit or die with new young consumers,” said WHO Director-General Dr. Margaret Chan. “A ban on all tobacco advertising, promotion and sponsorship is a powerful tool we can use to protect the world’s youth.”

    The WHO said that tobacco companies are specifically targeting the half billion youth in the Asia Pacific region by tying smoking to the idea of a flashy lifestyle. The agency said the tobacco industry attempts to take advantage of children’s susceptibility to advertising and marketing.

    According to the WHO most people take up smoking before they reach age 18, and almost twenty-five percent of smokers worldwide are under the age of 10. The agency said that a survey of 13 to 15 year-olds found that fifty-five percent had seen cigarette ads on billboards in the prior month, and twenty-percent owned something with a cigarette company’s logo.

    According to BBC News, in the last ten years female and adolescent smoking in Russia has tripled. Russia does not have many anti-smoking laws. BBC News compared this to Canada, where smoking levels are at their lowest in 40 years and the country has very restrictive laws on smoking advertising.

    “The tobacco industry employs predatory marketing strategies to get young people hooked to their addictive drug. But comprehensive advertising bans do work, reducing tobacco consumption by up to 16% in countries that have already taken this legislative step,” said Dr. Douglas Bettcher, Director of WHO’s Tobacco Free Initiative.

    A report by the WHO on tobacco use stated that approximately two thirds of the planet’s smokers reside in 10 countries including China, India, Indonesia, Russia, the United States, Japan, Bangladesh, Germany, and Turkey. Reuters reported that companies Philip Morris, Imperial Tobacco, British American Tobacco and Japan Tobacco are among the world’s largest producers of cigarettes.



    Chef who appeared on Gordon Ramsay’s ‘Kitchen Nightmares’ commits suicide

    Joseph Cerniglia, a chef who had appeared on Gordon Ramsay’s television show Kitchen Nightmares, has commited suicide. Cerniglia was the owner of Italian restaurant Campania. He jumped off a bridge into the Hudson river on the New York–New Jersey border. At the time of filming in 2007, Cerniglia owed suppliers $80,000.

    Officials reported that 39-year-old Cerniglia had jumped off of the George Washington Bridge into the Hudson. His death has officially been ruled as suicide. His body was retrieved from the river after reports of a man jumping off of the bridge.

    Ramsay released a statement to the Press Association saying “I was fortunate to spend time with Joe during the first season of Kitchen Nightmares. Joe was a brilliant chef, and our thoughts go out to his family, friends and staff.”

    Cerniglia told Ramsay about his personal debt when he came to the restaurant in 2007. He said “I am financially in trouble. The debt of the restaurant alone is overwhelming. My personal debt — wife, kids, mortgage — that’s a lot of debt”.
